AskMandla Terms & Conditions
1. INTRODUCTION
1.1. These Terms and Conditions ("Terms") govern your access to and use of AskMandla.com, including all related services provided through our website or WhatsApp platform ("Platform").
1.2. AskMandla.com ("AskMandla", "we", "us", or "our") is operated by Ask Mandla Pty Ltd, a private company registered in South Africa under registration number 2025/389046/07. We provide employment compliance, HR support, payroll tools, and financial inclusion services for domestic and small business employers and their employees in South Africa.
1.3. By using our services, you agree to be legally bound by these Terms. If you do not accept these Terms, you must refrain from using our services.
2. DEFINITIONS
- "Employer": A user who engages domestic or small business employees and uses AskMandla services to manage their employment relationship.
- "Employee": An individual employed by an Employer and registered with AskMandla.
- "User": Any individual using AskMandla's services, including Employers and Employees.
- "Services": All employment, compliance, payroll, HR, and financial features provided by AskMandla.
3. SCOPE OF SERVICES
3.1. AskMandla provides:
- Generation of compliant employment contracts
- Leave and attendance tracking
- Payslip and payroll calculations
- UIF registration and guidance
- Optional add-ons like earned wage access, legal support, and performance reviews
3.2. Our services are not a substitute for professional legal or financial advice. All guidance is general in nature unless specified.
4. REGISTRATION
4.1. Employers must provide accurate personal and employment information when signing up. This information is used to generate contracts and payslips.
4.2. Verification of identity may be required.
5. PAYMENT TERMS
5.1. Basic contract generation is a paid service. Access to payroll, payslips, leave tracking, and support tools requires a paid subscription.
5.2. AskMandla charges a monthly subscription fee based on the Employer's chosen pay cycle. Employers on a weekly pay cycle are charged R196.00 per month, those on a bi-weekly cycle are charged R98.00 per month, and those on a monthly cycle are charged R49.00 per month. This subscription fee covers the processing of all payroll runs within the applicable pay cycle. All fees are debited from the Employer's account at the time of processing. AskMandla reserves the right to adjust these fees on reasonable written notice to the Employer.
5.3. AskMandla integrates third-party payment gateways. Transaction processing fees may apply and are disclosed at checkout.
5.4. Users are responsible for funding the wallet or account from which employee salaries or deductions will be made.
5.5. A once-off joining fee applies upon registration. The current fee is R450, which covers account setup, compliance verification, and onboarding support.
5.6. A loan processing fee of R29 (excluding VAT) is payable by the Employer each time AskMandla processes a loan deduction on the Employer's behalf. This fee is charged per deduction cycle and will be debited from the Employer's account at the time of processing. AskMandla reserves the right to adjust this fee on reasonable written notice to the Employer.
5.7. AskMandla reserves the right to amend the joining fee and the subscription fee from time to time, and any changes will be communicated to Users through official channels or displayed on the Platform prior to payment.
6. EMPLOYMENT RELATIONSHIP AND COMPLIANCE
6.1. AskMandla is not the legal employer unless explicitly agreed to under a separate Employer-of-Record agreement.
6.2. Employers are responsible for:
- Ensuring compliance with the BCEA, LRA, and UIF Acts
- Approving leave, verifying work hours
- Confirming sick notes or documents uploaded
6.3. Employees are expected to:
- Submit accurate attendance and leave information
- Notify the employer promptly of absence
7. TERMINATION AND SUSPENSION
7.1. AskMandla may suspend or terminate services if:
- Fraud, abuse or unauthorised use is detected
- Payment failures or chargebacks occur
- Terms are breached by the User
7.2. Upon termination, contracts and records will remain stored in compliance with legal requirements.
8. PRIVACY, DATA AND CONFIDENTIALITY
8.1. All personal data is processed in line with the Protection of Personal Information Act (POPIA).
8.2. Data is used to generate employment documentation, calculate wages, manage compliance, and provide support.
8.3. AskMandla does not sell personal data. Aggregated, anonymised data may be used for analytics and service improvement.

8.5. AskMandla is an Accountable Institution under the Financial Intelligence Centre Act, 38 of 2001 ("FICA"). In fulfilment of its legal compliance obligations, AskMandla screens all prospective and existing employer clients against applicable sanctions lists, Politically Exposed Persons (PEP) and Prominent Influential Persons (PIP) databases, and adverse media sources during onboarding and on an ongoing basis throughout the business relationship.
8.6. This screening is conducted through authorised third-party anti-money laundering (AML) screening service providers and involves the processing of the employer's name, identity number, registration number, or other identifying information, as applicable.
8.7. Such processing is necessary for AskMandla to comply with its legal obligations under FICA and, where applicable, for the conclusion and performance of its contractual relationship with the employer. Accordingly, the processing is lawful in terms of sections 11(1)(c) and, where relevant, 11(1)(b) of the Protection of Personal Information Act, 4 of 2013 ("POPIA"), and does not require the data subject's consent.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1. AskMandla provides services "as is" and "as available", without warranties of any kind.
9.2. We are not liable for:
- Incorrect information submitted by Users
- Any tax, UIF or legal obligations incorrectly calculated based on inaccurate data
- Decisions made by Employers or Employees using our guidance
9.3. Maximum liability is limited to the subscription fees paid in the last 3 months.
10. GOVERNING LAW AND DISPUTES
10.1. These Terms are governed by the laws of the Republic of South Africa.
10.2. Any disputes shall be resolved in accordance with the Consumer Protection Act and related legislation, with venue in the High Court of South Africa, Western Cape Division.
11. CHANGES TO TERMS
11.1. AskMandla reserves the right to amend these Terms at any time. Changes will be communicated via email or other official channels.
11.2. Continued use of our services constitutes acceptance of the updated Terms.
